DTAA for the UAE and Saudi Arabia: do you need it?
Draft: not yet reviewed by a CA.
A DTAA is a tax treaty that stops the same income being taxed twice and can lower Indian tax on items such as interest. Many Gulf countries charge no personal income tax, so double taxation is rarely the issue. The treaty still matters for rates, and claiming it usually needs a Tax Residency Certificate.
What does a DTAA do?
It decides which country may tax which income, and it can cap the rate India charges on things like interest. India has treaties with the UAE, Saudi Arabia, Qatar, Kuwait, Oman and Bahrain.
Why does it matter if the Gulf has no income tax?
Because the benefit is often a lower Indian rate, not a credit for foreign tax. Treaty rates on NRO interest, for example, can be lower than the normal TDS rate. Rates differ by treaty, so check the one for your country.
What do you need to claim it?
- A Tax Residency Certificate from your country of residence.
- Form 10F, filed online.
- A self-declaration, if your bank or payer asks for one.
Get these before filing, because the certificate takes time in some countries.
Is it worth doing?
Compare the tax saved with the effort. It tends to help when you have significant interest or other Indian income. An expert can work it out for your figures through our residential status and DTAA service.
